How can we look in the eyes of our fellow citizens of Armenian heritage, while we know that there are those among us who deny the suffering of their grandparents?\u201d said yet another Member of Parliament. \u201cRacism is not an opinion, it\u2019s a crime,\u201d said another.<br \/>\nThe <a title=\"No. 813 Law Proposition\" href=\"http:\/\/www.assemblee-nationale.fr\/13\/ta\/ta0813.asp\" target=\"_blank\">no. 813 law proposition<\/a> of the National Assembly is based on the 29\/7\/1881 law of France and additionally it serves harmonizing with the <a title=\"2008\/913\/JHA EU Council Framework decision\" href=\"http:\/\/http:\/\/europa.eu\/legislation_summaries\/justice_freedom_security\/combating_discrimination\/l33178_en.htm\" target=\"_blank\">2008\/913\/JHA EU Council framework decision<\/a> on combating certain forms and expressions of racism and xenophobia by means of criminal law and incorporating it into the French jurisprudence.<br \/>\nThe legislative power of France consistent with its convictions illustrated in the 2001-70 law (29\/1\/2001) with which France has recognized the Genocide perpetrated in 1915 against the Armenians reaffirmed once more its position as human rights\u2019 pioneer defender. The penalties provisioned in the law proposition are a year in jail and a fine of 45.000 euros.<br \/>\nThe legislative procedure requires that the law proposition be submitted to the Senate for approval and afterwards be signed by the President of France.<\/p>\n<p style=\"text-align: justify;\"><span style=\"text-decoration: underline;\">Below is the original and the translation of the <a title=\"No. 813 Law Proposition\" href=\"http:\/\/www.assemblee-nationale.fr\/13\/ta\/ta0813.asp\" target=\"_blank\">no 813 law proposition<\/a>:<\/span><br \/>\n<em>The National Assembly adopted a law proposition with the following content:<\/em><\/p>\n<p style=\"text-align: justify;\">Look numbers <strong>3842<\/strong> and <strong>4035<\/strong>.<br \/>\n<strong> <\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Article 1<\/strong><br \/>\nThe 1st paragraph of the IV chapter of the 29 July 1881 law on the freedom of press is completed by an Article 24 ter composed as follows:<\/p>\n<p style=\"text-align: justify;\">\u201cArt. 24 ter.- The penalties provisioned in Article 24 bis are applicable upon those who by the use of any of the means stated in article 23 contest or minimize in an excessive manner the existence of one or more crimes of genocide defined in the article 211-1 of the penal code and acknowledged as such by the French law.<\/p>\n<p style=\"text-align: justify;\">Furthermore, the court can order the display or the diffusion of the adjudged decision under the conditions provisioned in the article 131-35 of the penal code.\u201d<br \/>\n<strong><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Article 2<\/strong><\/p>\n<p style=\"text-align: justify;\">The Article 48-2 of the same law is modified as follows:<\/p>\n<p style=\"text-align: justify;\">1. After the word \u201cdeported\u201d the following words are inserted: \u201c or all the other victims of crimes of genocide, crimes of war, crimes against humanity or of crimes or offences of collaboration with the enemy\u201d,<\/p>\n<p style=\"text-align: justify;\">2. At the end, the words: \u201cthe infringement provisioned by the article 24 bis\u201d are replaced by the words \u201cthe infringements provisioned in the articles 24 bis and 24 ter\u201d.<\/p>\n<p style=\"text-align: justify;\"><em>Public Session resolution, Paris 22 December 2011<\/em><\/p>\n<p style=\"text-align: justify;\">&nbsp;<\/p>\n<p style=\"text-align: justify;\"><em>L\u2019Assembl\u00e9e nationale a adopt\u00e9 la proposition de loi dont la teneur suit :<\/em><\/p>\n<p style=\"text-align: justify;\">Voir les num\u00e9ros : <strong>3842<\/strong> et <strong>4035<\/strong>.<br \/>\n<strong><\/strong><\/p>\n<p style=\"text-align: justify;\"><strong>Article 1er<\/strong><\/p>\n<p style=\"text-align: justify;\">Le paragraphe 1er du chapitre IV de la loi du 29 juillet 1881 sur la libert\u00e9 de la presse est compl\u00e9t\u00e9 par un article 24 ter ainsi r\u00e9dig\u00e9 :<\/p>\n<p style=\"text-align: justify;\">\u00ab Art. 24 ter. \u2013 Les peines pr\u00e9vues \u00e0 l\u2019article 24 bis sont applicables \u00e0 ceux qui ont contest\u00e9 ou minimis\u00e9 de fa\u00e7on outranci\u00e8re, par un des moyens \u00e9nonc\u00e9s \u00e0 l\u2019article 23, l\u2019existence d\u2019un ou plusieurs crimes de g\u00e9nocide d\u00e9fini \u00e0 l\u2019article 211-1 du code p\u00e9nal et reconnus comme tels par la loi fran\u00e7aise.<\/p>\n<p style=\"text-align: justify;\">\u00ab Le tribunal peut en outre ordonner l\u2019affichage ou la diffusion de la d\u00e9cision prononc\u00e9e, dans les conditions pr\u00e9vues \u00e0 l\u2019article 131-35 du code p\u00e9nal. \u00bb<\/p>\n<p style=\"text-align: justify;\"><strong>Article 2<\/strong><\/p>\n<p style=\"text-align: justify;\">L\u2019article 48-2 de la m\u00eame loi est ainsi modifi\u00e9 :<\/p>\n<p style=\"text-align: justify;\">1\u00b0 Apr\u00e8s le mot : \u00ab d\u00e9port\u00e9s \u00bb, sont ins\u00e9r\u00e9s les mots : \u00ab , ou de toute autre victime de crimes de g\u00e9nocide, de crimes de guerre, de crimes contre l\u2019humanit\u00e9 ou de crimes ou d\u00e9lits de collaboration avec l\u2019ennemi \u00bb ;<\/p>\n<p style=\"text-align: justify;\">2\u00b0 \u00c0 la fin, les mots : \u00ab l\u2019infraction pr\u00e9vue par l\u2019article 24 bis \u00bb sont remplac\u00e9s par les mots : \u00ab les infractions pr\u00e9vues aux articles 24 bis et 24 ter \u00bb.<\/p>\n<p style=\"text-align: justify;\"><em>D\u00e9lib\u00e9r\u00e9 en s\u00e9ance publique, \u00e0 Paris, le 22 d\u00e9cembre 2011.<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(ACF) On December 22, the National Assembly of France adopted a law proposition criminalizing the negation of Genocides acknowledged as such by the French law.
